Taylor Swift asks judge to reconsider ‘Shake It Off’ plagiarism lawsuit

The pop star’s team is asking the judge to reconsider moving forward with the case and lawsuit claiming that Swift lifted some of her song’s lyrics from 3LW’s “Playas Gon’ Play.”

According to Fox News, that decision had ruled Swift’s copyright infringement lawsuit over her single ‘Shake It Off’ could proceed in court.
In new documents obtained by the outlet, attorneys for the pop star called the judge’s December 9 ruling for the case to proceed to a jury trial “unprecedented.”
The court filing stated, “The Order does something that, as far Defendants are aware, no other court has done, namely finding a potentially valid infringement claim in the use of two short public domain phrases along with allegedly similar ideas and concepts. Defendants respectfully submit that the ruling should be revisited.”
Songwriters Sean Hall and Nathan Butler claimed back in 2017 that lyrics for the singer’s catchy song was ripped from 3LW’s 2001 single, ‘Playas Gon’ Play’.

Swift’s team argued on December 23 that the lyrics “players gonna play” and “haters gonna hate” are unprotected and in the public domain. The plaintiffs have also “admitted” that argument, her lawyers insist in the documents.
In a statement to Fox News on Wednesday, a lawyer for Hall and Butler said of Swift’s filing, “We represent two amazing lower-income black artists with pride. The motion filed by the Taylor Swift camp does not satisfy the legal conditions for reconsideration. They are sore losers and should as she sings ‘shake it off.'”

The pop star’s 2014 hit off her ‘1989’ album was a huge success as it shot to the top of the Billboard Hot 100 chart. The album also broke records after selling more than 1.2 million copies in its first week.
In 2020, U.S. District Judge Michael Fitzgerald ruled that Hall and Butler have “sufficiently alleged a protectable selection and arrangement or a sequence of creative expression.” The federal judge added that their claim of the 32-year-old’s copyright infringement is “similar enough” to not be dismissed.
That decision came three years after the same judge dismissed Hall and Butler’s initial claims. He ruled that the lyrics “lacked sufficient originality to merit copyright protection,” Deadline reported. An appeals court had then overturned that decision in 2018.
The songwriters are seeking a portion of Swift’s earnings from the song, which the outlet reported has sold more than 9 million copies since the lawsuit was filed. (ANI)

Taylor Swift – Shake It Off

Taylor Swift Shake It Off Lyrics

I stay out too late
Got nothing in my brain
That’s what people say, mm, mm
That’s what people say, mm, mm
I go on too many dates
But I can’t make ’em stay
At least that’s what people say, mm, mm
That’s what people say, mm, mm
But I keep cruising
Can’t stop, won’t stop moving
It’s like I got this music in my mind
Saying it’s gonna be alright
‘Cause the players gonna play, play, play, play, play
And the haters gonna hate, hate, hate, hate, hate
Baby, I’m just gonna shake, shake, shake, shake, shake
I shake it off, I shake it off (Whoo-hoo-hoo)
Heartbreakers gonna break, break, break, break, break
And the fakers gonna fake, fake, fake, fake, fake
Baby, I’m just gonna shake, shake, shake, shake, shake
I shake it off, I shake it off (Whoo-hoo-hoo)
I never miss a beat
I’m lightning on my feet
And that’s what they don’t see, mm, mm
That’s what they don’t see, mm, mm
I’m dancing on my own (Dancing on my own)
I make the moves up as I go (Moves up as I go)
And that’s what they don’t know, mm, mm
That’s what they don’t know, mm, mm
But I keep cruising
Can’t stop, won’t stop grooving
Shake it off, I shake it off
I, I, I shake it off, I shake it off
I, I, I shake it off, I shake it off
I, I, I shake it off, I shake it off (Whoo-hoo-hoo)
Hey, hey, hey
Just think while you’ve been gettin’ down and out about the liars
And the dirty, dirty cheats of the world
You could’ve been gettin’ down
To this sick beat
My ex man brought his new girlfriend
She’s like, “Oh my God!”
I’m just gonna shake
And to the fella over there with the hella good hair
Won’t you come on over baby?
We can shake, shake, shake (Yeah)
Yeah, oh
‘Cause the players gonna play, play, play, play, play
And the haters gonna hate, hate, hate, hate, hate (Haters gonna hate)
Baby, I’m just gonna shake, shake, shake, shake, shake
I shake it off, I shake it off (Whoo-hoo-hoo)
Heartbreakers gonna break, break, break, break, break
And the fakers gonna fake, fake, fake, fake, fake (And fake, and fake, and fake)
Baby, I’m just gonna shake, shake, shake, shake, shake
I shake it off, I shake it off (Whoo-hoo-hoo)
Shake it off, I shake it off
I, I, I shake it off, I shake it off
I, I, I shake it off, I shake it off
I, I, I shake it off, I shake it off (Whoo-hoo-hoo)
Shake it off, I shake it off
I, I, I shake it off, I shake it off (You got to)
I, I, I shake it off, I shake it off
I, I, I shake it off, I shake it off

What is the Origin of Shake It Off?

“Shake It Off” is a song by American singer-songwriter Taylor Swift. It was written by Swift and its producers, Max Martin and Shellback.

“Shake It Off” is an uptempo dance-pop song featuring a saxophone line in its production. The lyrics are about Swift’s indifference to her detractors and their negative view of her image. The song was the lead single from her fifth studio album, 1989, which Swift marketed as her first pop album. It was released for digital download worldwide on August 19, 2014, by Big Machine Records.

Contemporary critics found the song’s dance-pop production catchy, but some believed the lyrics were weak. Retrospectively, critics have considered “Shake It Off” an effective opener for the 1989 era, which transformed Swift’s sound and image from country to pop. The song featured on 2010s decade-end lists by NME and Consequence. In the U.S., the single spent 50 weeks–including four weeks at number one–on the Billboard Hot 100, and received a Diamond certification from the Recording Industry Association of America (RIAA). “Shake It Off” also topped charts in Australia, Canada, Hungary, Mexico, New Zealand, and Poland.
